By opening an account with Cruzio.com, you agree to abide by all policies of Cruzio. These policies apply to all users of Cruzio without exception; failure to adhere to the stated policies may result in termination of the account at the discretion of Cruzio.
Disclaimer of Liability
Cruzio exercises no control whatsoever over the content of the
information passing through its systems. Cruzio makes no warranties
of any kind, expressed or implied, for services provided. Cruzio
disclaims any warranty of merchantability or fitness for a particular
service. Cruzio is not responsible for any damage suffered from
the direct or indirect use of its services. This includes, but
is not limited to: expenses and loss of data resulting from delays,
nondeliveries, misdeliveries, or service interruptions caused
by its own negligence or errors or omissions. Use of any information
via Cruzio is at your own risk. Cruzio specifically denies any
responsibility for the accuracy or quality of information obtained
through its services. In accordance with Business and Professions
Code, Section 17538.35, Cruzio will provide at least a 30-day
notice prior to permanently terminating a customer's electronic
mail address, except in cases where that customer has violated
these Conditions.
Restrictions
Cruzio may only be used for lawful purposes. Transmission or storage
of material in violation of federal, state, or local regulations
is prohibited. This includes, but is not limited to, material
that is: copyrighted, judged to be threatening, compromises security
or privacy, or is protected by trade secret. Cruzio reserves
the right to remove or modify, at its discretion, any material
in violation of these policies. You agree to comply with the
rules and restrictions appropriate to other networks and services
connected directly or indirectly to Cruzio. This includes, but
is not limited to, the Acceptable Use Policies established for
Usenet and the Internet as a whole which expressly prohibits
certain commercial solicitation. You agree to not send unsolicited
advertisements ("junk mail") through the Internet and
not to send email to anyone after they have asked you to stop
sending them email ("harassment"). You agree to not
post material not related to the topic of discussion of a newsgroup
("newsgroup abuse"). You agree not to dial in to one
account from more than one computer simultaneously.
Cruzio services are intended for periodic, active use of email,
newsgroups, file transfers, Internet chat, games, and browsing
the World Wide Web. You may stay connected so long as you are actively
using your connection for the above purposes. You agree not to
use Cruzio services on a standby or inactive basis in order to
maintain a connection. Unlimited accounts are not defined as dedicated
accounts. Cruzio reserves the right to disconnect dialup users
who are idle or have been connected for an exorbitant amount of
time. Currently, dialup users are disconnected after 12 minutes
of inactivity or after 6 hours of continual use. These parameters
can be changed at any time at Cruzio's discretion.
You agree to not attempt to gain access to the Cruzio operating
system through a security hole, or by any other means whatsoever,
nor to attempt to install any software in the Cruzio operating
system. You agree to indemnify and hold harmless Cruzio from any
claims resulting from your conduct and/or use of the service which
damages you or another party. Cruzio reserves the right to refuse
service to anyone, and to terminate any account at any time for
reasons including, but not limited to, violation of the Terms and
Conditions of this contract, default of payment, or without cause
on 10 days written notice by email, US Mail, or fax. Cruzio customers
are strictly forbidden to resell or re-allocate bandwidth to a
third party for any purpose without Cruzio's express written permission.
Failure to comply with this condition will result in cancellation
of the service at Cruzio's discretion.
DSL customers must maintain AT&T telephone service in continuous
working order to maintain the DSL circuit. Any action, or inaction,
resulting in AT&T telephone service being disconnected or changed
(including changing the name associated with your AT&T service)
will result in loss of DSL service.
Payment Obligations Payment
is due within 15 days of the account anniversary (the date it was
officially established) each period. Late fees may apply if payment
is not received by the due date. Accounts are in default if payment
is not received within 25 days of its due date. Accounts in default
may be suspended. Such interruption does not relieve you from paying
past due and ongoing charges. Cancel requests must be received
by email, US Mail, or fax. Only a written request to terminate
your service relieves you of your obligation to pay further account
charges. It does not relieve you of past obligations and charges
or from any prior agreements to pay, including but not
limited to unpaid equipment charges. If you default, you agree
to pay Cruzio's reasonable expenses, including attorney and collection
fees, incurred in enforcing its
rights under these Conditions. Prepaid accounts are not refundable
for any reason if terminated early. Setup fees are not refundable
for any reason. Unused services will be refunded in whole months
only.
Your signature on the Cruzio application, or use of Cruzio, construes
acceptance of these Conditions which supersede all previous representations,
understandings, or agreements and shall prevail notwithstanding
any variance with Terms and Conditions of any order. Cruzio reserves
the right to modify these Conditions and change pricing or services
at any time without notice. Cruzio may immediately terminate your
account for violation of any of these Conditions.
